Welcome to Empower Learning Solutions! These Terms and Conditions (“Terms”) govern the booking and scheduling of appointments for services provided by Empower Learning Solutions (“we,” “our,” or “us”). By booking an appointment with us, you (“Client,” “you,” or “your”) agree to these Terms. Please read them carefully.

To book an appointment with Empower Learning Solutions, you may do so through our website, by phone, or through other methods we provide. By scheduling an appointment, you confirm that:

• You are at least 18 years old or have the consent of a parent/guardian if you are under 18.
• All the information you provide for booking, including your contact details, is accurate and complete.

Upon booking, you will receive an appointment confirmation via email or text, depending on the method chosen. This confirmation will include the date, time, location, and any necessary instructions for your appointment. Please ensure that you carefully review the details and let us know immediately if there are any discrepancies.

We understand that schedules can change, and we strive to be as flexible as possible. If you need to modify or cancel your appointment, please adhere to the following guidelines:

• Cancellation Policy: Cancellations must be made at least 1 day before your scheduled appointment time. If you fail to provide sufficient notice, you may be subject to a cancellation fee of $50.00.
• Rescheduling: If you need to reschedule your appointment, please notify us at least 1 day in advance. We will make every effort to accommodate your new preferred time but cannot guarantee availability.
• No-Show Policy: If you miss your appointment without prior notice, you may be charged a $50.00 no-show fee. After a certain number of no-shows, we may reserve the right to refuse further appointments.

• Pricing: All services are subject to the pricing listed on our website or communicated to you at the time of booking. Prices are subject to change, but you will be informed of any changes before confirming your booking.
• Payment Methods: We accept payments via credit card, PayPal, health insurance, or bank transfer. Payment for services must be made in full before or at the time of your appointment unless other arrangements have been made.
• Refund Policy: We strive to provide the best service possible. If you are dissatisfied with your appointment or service, please contact us immediately to discuss a resolution. 

If you arrive late for your appointment, we will make every effort to accommodate you. However, if you are more than 10 minutes late, your appointment may be shortened or rescheduled, and you may still be charged for the full service.

Appointments are provided based on the services described on our website or as communicated directly to you. Any additional services or requests not covered under the original booking will be subject to additional charges, and you will be informed before proceeding with any changes.

If your appointment involves health-related services or the provision of healthcare training, you may be asked to provide certain medical or health-related information. We take your privacy seriously and will handle your information in accordance with our Privacy Policy, including compliance with HIPAA (Health Insurance Portability and Accountability Act).

• You agree to provide accurate and up-to-date health information for your appointment, if applicable.
• If you are booking on behalf of a minor or another person, you confirm that you have the necessary consent and authority to provide the required health information.

Empower Learning Solutions is committed to providing accessible services to all clients, including those with disabilities, in accordance with the Americans with Disabilities Act (ADA). If you require any special accommodations to participate in your appointment (such as alternative formats, accessibility tools, or assistance), please notify us at least [Insert number of hours or days] before your appointment.

All materials, content, and resources provided to you during your appointment (e.g., training materials, presentations, etc.) are protected by intellectual property laws. You agree not to reproduce, distribute, or otherwise use these materials for commercial purposes without prior written consent from Empower Learning Solutions.

To the maximum extent permitted by law, Empower Learning Solutions is not responsible for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your appointment or any failure to attend an appointment. Our total liability for any claim or dispute related to these Terms shall not exceed the amount paid by you for the appointment that is the subject of the claim.

You agree to indemnify, defend, and hold harmless Empower Learning Solutions, its employees, agents, contractors, and affiliates from any claims, liabilities, damages, losses, or expenses (including reasonable attorney’s fees) arising from or related to your booking, attendance, or participation in any appointment.

Empower Learning Solutions shall not be held liable for any failure to perform its obligations under these Terms if such failure is caused by events beyond its reasonable control, including but not limited to natural disasters, strikes, pandemics, or government restrictions.

We reserve the right to modify or update these Terms and Conditions at any time. Any changes will be posted on our website, and the updated Terms will be effective immediately upon posting. We encourage you to review these Terms periodically to stay informed about any updates.

These Terms and Conditions shall be governed by and construed by the laws of New Hampshire without regard to its conflict of law principles. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in Stratford County.
